Welcome to NOMA. These Terms and Conditions (“Terms”) govern your access to and use of the NOMA mobile applications, website, and related services (collectively, the “Service”), operated by NOMA (“we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
NOMA is a platform that helps travelers discover Morocco by booking activities, renting cars, and planning trips through third-party providers (“Providers”). NOMA acts as an intermediary between you and the Providers. The contract for any booking is between you and the relevant Provider; NOMA is not a party to that contract unless expressly stated.
2. Eligibility and Accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You agree to provide accurate information when creating an account and to keep your credentials confidential. You are responsible for all activity that occurs under your account.
3. Bookings and Payments
When you make a booking through NOMA, you agree to pay the price displayed, including any taxes, deposits, and service fees. Payments are processed by third-party payment providers. Prices, availability, and the terms of each activity, rental, or service are set by the Provider and may change without notice prior to confirmation.
4. Cancellations and Refunds
Cancellation and refund rules vary by Provider and are shown before you confirm a booking. Unless otherwise stated, refunds are subject to the Provider’s policy. Where required by law, you retain any statutory cancellation rights.
5. Car Rentals
For car rentals, you must hold a valid driving license accepted by the Provider and meet any age or experience requirements stated by the Provider. You are responsible for complying with all traffic laws and for any fines, damages, or charges incurred during the rental period in accordance with the Provider’s rental agreement.
6. User Conduct
You agree not to:
- Use the Service for any unlawful or fraudulent purpose;
- Misrepresent your identity or impersonate any person;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service;
- Upload content that is illegal, harmful, defamatory, or infringes on others’ rights;
- Use automated means (scrapers, bots) to access the Service without our written consent.
7. Content and Reviews
You may submit reviews, photos, or other content. By doing so, you grant NOMA a worldwide, non-exclusive, royalty-free license to use, reproduce, and display that content in connection with the Service. You are responsible for the content you submit and represent that you have the right to share it.
8. Intellectual Property
The NOMA name, logo, software, and all related content are owned by NOMA or its licensors and are protected by intellectual property laws. You may not copy, modify, or create derivative works from any part of the Service without our prior written consent.
9. Disclaimers
The Service is provided “as is” without warranties of any kind. NOMA does not warrant the quality, safety, or legality of services offered by Providers, and is not responsible for any act or omission of any Provider. Your use of the Service and any booking is at your own risk, subject to mandatory consumer protections.
10. Limitation of Liability
To the maximum extent permitted by law, NOMA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Service. NOMA’s total liability for any claim relating to the Service shall not exceed the amount you paid to NOMA in the twelve months preceding the claim.
11. Termination
We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms or if required by law. You may stop using the Service at any time. Sections that by their nature should survive termination will continue to apply.
12. Governing Law
These Terms are governed by the laws of the Kingdom of Morocco, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be submitted to the competent courts of Casablanca, Morocco, unless mandatory law provides otherwise.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting an updated version on this page and updating the “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
